All all items are SOLD "AS IS WHERE IS" ALL SALES ARE FINAL WITH NO WARRANTIES EXPRESSED OR IMPLIED..
There will be no refunds so please come inspect these items during inspection hours. The items sold here are either available for inspection at our location on a set day and time put forth in that auction sales and terms or can be viewed at the sellers place of business during agreed times and days.
Lexington Online Auction stronly encourages you to inspect the items prior to bidding for description accuracy and condition prior to bidding. Bids cannot be rertracted unless you have entered and wrong amount and must be done brfore the end of auction. Lexington Online Auction and our sellers do our best to describe every item as accurately and honest as possible but even we may over look something occasionally so we encourage you please inspect the item prior to bidding.
Lexington Online Auction cannot be held liable for a oversight so please come see the items before bidding on the item online. Bidders, Consigners and Lexington Online Auction agree that the terms and conditions set forth below shall govern this online auction. Warranty/Gaurentee Disclaimer Information that is used or shared by Lexington Online Auction in connection with this auction that has been provided by our client, the owner/seller, is believed to be true and correct but we do not gaurentee this information so please come to inspection. Lexington Online Auction, its owners, agents and other representatives, are not responsible for any information that is provided in connection with this online auction sale that are misunderstood or misleading. Lexington Online Auction and it's auctioneers and agents will not deal with sellers that have been determined to be misleading or ues gray area sales tactics . Lexington Online Auction does not warrent or will we as auctioneers,agents take responsibility for the actions of the sellers but we will do our part in rectifying the issue if one were to occur. Bidding Eligability We can only offer our services to people over the age of 18 and you must have a valid Credit Card to put on file prior to bidding. We can sell to a business enity if you are the approved bidder for that enity and we can verify that. Bidder Information All information provided by you the bidder should be current at the time of the sale. If at anytime your information has changed you would need to update this information asap.
Bidding on our Online Auction site:
Bidding is done online and you must monitor your bid to see where you stand during the auction start and end time frame. You can enter a max bid and the system will bid for you up to your max bid but will not bid over the amount you have input so at the end of the auction you should be online or increase your max bid when outbid or enter a new max bid. You, as a bidder, understand and agree to how the maximum bid feature works if you choose to use it. You may or may not automatically receive notification if another bidder outbids your maximum bid so it's up to you to keep up with the bid on the items you have bid on. Your internet conection is the most important thing if you plan on placing bids at the last moment and we Lexington Online Auction cannot be held liable for you missing a bid due to internet issues on your part or ours so don't wait to bid! The owner/seller of property sold through Lexington Online Auction reserves the right to reject any and all bids unless auction is advertised absolute or without reserve.
As a bidder:
By agreeing to the terms and placing a bid you are entering a binding contract. You are responsible for any bids placed by you or a designated representative under your bidding number and password. The security of your bidder information is your sole responsibility and the bidder will be responsible for any and all bids placed under the assigned number. If, at any time, you feel that your bidder number and password have been compromised, due to lack of security on your part, you must notify us immediately. Auctioneer is the one and only judge regarding the determination of winning bidders, and the single deciding authority if disputes should arise, and accepts no liability for any errors or omissions. Lexington Online Auction reserves the right to reopen bidding on any disputed bids. Despite efforts to avoid the withdrawal of lots from the online auction sale after they are listed, it may sometimes be necessary to withdraw lots, therefore, the owner/seller reserves the right to do so at any time before or during the online auction sale.
Bid Retractions: There are no bid retractions. ALL BIDS ARE NON-CANCELLABLE ONCE SUBMITTED. Once a bid is made and confirmed, it cannot be retracted. When a bid is made you manifest your intent and ability to buy the lot at the bid price. A false or fraudulent bid may result in legal action. Any winning bidder who refuses to purchase the lot may be banned from all future online auctions.
Reserve Price: An auction lot may have a reserve price. The reserve price is the lowest price at which the lot will be sold. The reserve price is never disclosed to bidders, but a note may be displayed in the lot information screen specifying a reserve price. When the reserve price has been met the screen may read “reserve price met”. The lot will then be sold to the highest bidder at the conclusion of the online auction sale. When an article is sold with reserve the auctioneer may bid on the owner/seller’s behalf in an amount not to exceed the reserve price. If the reserve price is not met, the lot will not be sold during that online auction. The owner/seller reserves the right to accept or reject any or all bids unless otherwise stated. Winning Bidder: The high bidder at the end of the allotted bidding time for each lot at that time is the owner of that said item. All risk of damage, or injury/ death of livestock to each lot becomes the buyer’s risk upon the end of the allotted bidding time. Each buyer, following his or her purchase, will receive an acknowledgement of purchase via e-mail outlining the details of the transaction including payment, settlement, and final terms.
Payment of won item: Acceptable forms of payment are Visa or Mastercard. Buyer shall be responsible for making arrangements for delivery of merchandise or shipping of merchandise. All bids are in US Dollars; all settlements will be paid in US Dollars.
Pickup or transportation of won item: The buyer, Item(s) won via auction must be picked up as outlined in this auction or is considered abandoned and becomes property of Lexington Online Auction to do with as they please. At buyer’s own expense, shall transport the merchandise from the owner/seller. Specific arrangements will be indicated on each individual auction and expenses will be handled between buyer and owner/seller if not Lexington Online Auction. If you have questions regarding transportation, contact the owner/seller or Lexington Online Auction before placing any bids.
Limit of Liability: In no event shall the auctioneer be liable for lost profits or any special, incidental, or consequential damages whatsoever arising out of or in connection with any sale or transaction. Lexington Online Auction reserves the right to postpone or cancel a sale without notice, if it is determined that such action is appropriate for whatever reason in our sole discretion. Lexington Online Auction or our agents will neither have liability nor obligation to the intended bidders as a result of any withdrawal, cancellation, or postponement of any sale.
